KARVING12

MINERAL AND FOSSIL SCULPTURES

1. Purpose

These general terms and conditions of sale govern the sale of mineral and fossil sculptures, unique pieces, offered by Karving12 via its website.

2. Price

The prices displayed on the website correspond to the price of the works alone.

Shipping costs and mandatory transport insurance, tailored to the destination and characteristics of the artwork, are calculated automatically before the order is confirmed and included in the total amount payable.

The total amount of the order, including the price of the artwork, shipping costs, and transport insurance, is communicated to the customer before payment.

In accordance with Article 293 B of the General Tax Code, VAT is not applicable (exempt from tax). The prices indicated are therefore net of tax.

For shipments outside the European Union, the price displayed corresponds to the price of the sculpture alone. Any import duties and taxes that may be required by the authorities of the destination country remain the sole responsibility of the buyer. Delivery costs and compulsory transport insurance are calculated and included in the total amount of the order before payment.

3. Ordering and payment

Accepted payment methods are PayPal and bank transfer.

The order is only confirmed after receipt of full payment, including the price of the sculpture, mandatory transport insurance, and delivery costs, if applicable.

Any attempt at fraud, unauthorized payment, or abusive dispute of payment will result in the cancellation of the order and may be reported to the authorities or relevant payment providers.

4. Delivery and insurance

The sculptures are shipped by a specialized professional carrier chosen by Karving12.

Given the unique and fragile nature of the works, transport insurance must be taken out for each shipment. This insurance is included in the delivery costs.

In the event of loss or damage occurring during transport, Karving12's liability is limited to the implementation of the transport insurance taken out, under the conditions and limits provided for therein.

Delivery times are provided for informational purposes only when placing an order. Karving12 cannot be held responsible for delays attributable to carriers or events beyond its control.

5. Receipt of works – Transfer of risks

Delivery is deemed to have been made upon delivery of the work to the customer or to any person designated by the customer at the address indicated when the order was placed, as evidenced by the signature on the delivery note or any other proof of delivery used by the carrier.

Upon delivery, the risk of loss or damage is transferred to the customer.

It is the customer's responsibility to check the condition of the artwork and its packaging upon receipt.

Any anomaly, damage, or defect must be reported immediately to the carrier and notified to Karving12 by email in accordance with the conditions set out in the returns policy.

6. Delivery outside the European Union – Customs

For deliveries outside the European Union, the customer is solely responsible for paying any customs duties, local taxes, or import fees required by the authorities of the destination country.

Karving12 cannot be held responsible for delays, blockages, refusal of customs clearance, returns, or destruction of packages resulting from non-payment of these fees or failure to comply with import formalities by the customer.

In the event of refusal of delivery, inability to clear customs, or return of the package to the sender for any reason attributable to the customer or local authorities, the order will be considered fulfilled.

No refunds may be claimed, including for the price of the artwork, delivery costs, and transport insurance.

7. Unique works and right of withdrawal

The sculptures offered for sale are unique and fragile works of art.

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to unique works of art that are likely to deteriorate or degrade during return shipping. Consequently, no returns or refunds will be accepted after the order has been confirmed.

8. Force majeure

Karving12 cannot be held liable for any failure to perform or delay in performing its obligations resulting from events beyond its control, such as natural disasters, strikes, transport failures, technical breakdowns, or any other case of force majeure.

9. Intellectual property

All text, images, and content relating to the sculptures presented on this website are protected by applicable intellectual property laws. Any reproduction or use without prior written permission is prohibited.

10. Disputes and jurisdiction

These terms and conditions are subject to French law.
The language of the contract is French.

In the event of a dispute, an attempt to reach an amicable settlement will be preferred before any legal action. In the absence of an agreement, the competent courts will be those within the jurisdiction of Karving12's registered office, including for international customers.
